BY ACCESSING AND USING THE EMERGENCY VISIONS, INC. (“EVI”) SOLUTION OR BY ACCESSING AND USING THE EVI PUBLIC WEBSITE, YOU AGREE TO BE BOUND BY THESE PRIVACY POLICIES. IF YOU DO NOT WISH TO BE BOUND BY THESE POLICIES, YOU MAY NOT ACCESS OR USE THE EVI SOLUTION AND/OR THE EVI PUBLIC WEBSITE.
AGREEMENT BETWEEN YOU AND EVI
Overview
EVI is committed to protecting the privacy and security of the users of our Solution and public website. EVI’s goal is to provide You with secured access to our Solution and public website in a manner that delivers the information, resources and services that are most relevant and helpful to You. EVI operates under the following set of strict privacy principles:
• The only information EVI obtains about individual users via either our Solution or public website is that supplied voluntarily by You.
• In cases when EVI may need personal information to provide users with access to our Solution, to customized website content, or to inform them about new features or services, users are explicitly asked for that information.
• Personally identifiable information provided by users (name, address, etc.) will not be disclosed to anyone unless users indicate that EVI may do so, or unless required by law, in conjunction with a government inquiry, or in litigation or dispute resolution. The only exception is with the EVI Solution where system administrators for the organization for whom an individual is an “authorized user” will have access to personally identifiable information in order to provide system support.
• Only statistical information about EVI Solution users, or EVI Website users, as a group (usage habits, demographics, etc.) may be shared with any affiliate, subsidiary, sponsor, advertiser or partner of EVI, unless an appropriate confidentiality agreement is in place. EVI employs strict security measures to safeguard online transactions. All personal information is stored in a secured database.
The following discloses EVI’s Privacy and Security Policy related to information gathering, sharing, and dissemination practices for the access and utilization of the EVI Solution and the EVI Website. Additional terms and conditions, if any, regarding the collection and use of Your information may also be provided to You before You sign up for a particular service. You will learn what personally identifiable information of Yours is collected, how and when EVI might use that information, how EVI protects and secures that information, who has access to that information, and how You can correct any inaccuracies in the information.
What Information is Collected?
EVI collects certain information from its users in two ways: (a) from EVI Solution system software logs, and (b) user supplied information:
(a) System Software Logs
EVI’s Solution logs user access to the applications, and actions taken by the user with our applications, down to the field level. All actions are time-stamped, logged, and associated to a specific user ID for audit purposes. Further, EVI logs the IP address assigned to Your computer whenever You access the EVI Solution over the Internet. EVI collects IP addresses in order to conduct system administration, report aggregate information to affiliates, subsidiaries, sponsors, advertisers or partners, and to conduct site analysis. EVI will also use IP addresses to identify any users who refuse to comply with EVI’s Master Subscription Agreement and Privacy and Security Policy, and to identify users who threaten EVI’s service, site, users, clients, or others.
(b) User-Supplied Information
Access to, and use of, the EVI Solution requires authorized users to give EVI contact information such as their name, work phone number, e-mail address, and other demographic information such as organization, title/role, email address, work address, etc. The user’s contact information is used for EVI to contact the user when necessary, and for local use by system administrators for the organization for whom the individual is an authorized user. Users may, should they choose to (opt-in), provide personally identifiable information such as personal contact information (e.g., home address, home phone number, etc.), or confidential/sensitive information (e.g., drivers license number, state ID number, etc.) to the EVI Solution, but such information will not be disclosed to other users (other than local system administrators) without the user’s prior consent.
External Links from the EVI Solution or from the EVI Website
In order to provide users with greater value, EVI may provide links to various third party Web sites. However, even if a third-party affiliation exists between EVI and that destination site, EVI exercises no authority over linked sites, each of which maintains independent privacy and data collection policies and procedures. EVI assumes no responsibility or liability for these independent methods or actions and is not responsible for the independent policies or procedures of destination sites. Similarly, EVI cannot take responsibility for the privacy initiatives or the content of such Web sites. These destination links are provided only for Your convenience, and as such, You access them at Your own risk.
Third Party Advertising Services on the EVI Website
EVI may utilize certain third-party advertising services to display advertising for its business partners. If selected by the user on an opt-in basis (by clicking on the advertisement), these third-party services may place a cookie on Your computer for the purposes of ad tracking and presentation. EVI does not share personally identifiable user information with its advertising services.
Tracking Technologies
A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. EVI uses cookies on this site. We do not link the information we store in cookies to any personally identifiable information submitted while on our site.
We use both session ID cookies and persistent cookies. We use session cookies to make it easier for You to navigate our site. A session ID cookie expires when You close Your browser. A persistent cookie remains on Your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in Your Internet browser’s “help” file.
The use of cookies by our partners, affiliates, tracking utility company, and service providers is not covered by our privacy statement. We do not have access or control over these cookies. Our partners, affiliates, tracking utility company, and service providers use session ID cookies to securely identify and validate visitors to the website during their visit.
We and our third party advertising partner employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to our Your personally identifiable information.
We use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.
As is true of most Web sites, we and our third party tracking-utility partner gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.
We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site, and to gather demographic information about our user base as a whole.
Advertising
EVI partners with third party ad networks to manage our advertising on other sites. Our ad network partners use cookies and Web beacons to collect non-personally identifiable information about Your activities on this and other Web sites to provide You targeted advertising based upon Your interests. If You wish to not have this information used for the purpose of serving You targeted ads, You may opt-out by clicking here. Please note this does not opt-You-out of being served advertising. You will continue to receive generic ads.
Data Security
EVI hereby represents and warrants that it will utilize commercially reasonable efforts to implement administrative, technical, and physical safeguards to safeguard all data stored in our Solution and public website from and against tampering and unauthorized disclosures. This protection includes information submitted by a user even if such data is made anonymous by removing any identifying information. Further, EVI will use security/access software and/or procedures sufficient to reasonably protect against unauthorized access. To that extent, EVI shall maintain the confidentiality of passwords and other codes required for accessing our Solution and public website. Finally, EVI will closely monitor the emerging national privacy and security standards, and will use our best efforts to comply with these standards as they become available.
Collection of Information on EVI’s Public Website
The EVI public website contains sections where visitors and registered users are asked for contact and/or demographic information. This information is used to contact the user when necessary, and to provide information and services on an opt-in basis. Users may opt-out of receiving information and future contact from EVI (please see the opt-in section below). Demographic and profile data is also collected on our public website. This information may be shared with affiliates, subsidiaries, sponsors, advertisers or partners on an aggregate basis, but it does not indicate the identity of individual users.
E-Commerce on the EVI Website
Some EVI Website features may use applications to collect data to facilitate an e-commerce transaction, such as a software license or goods and services purchases. EVI will ask Your explicit permission to transfer this data to a third party (e.g., conference coordinator) to facilitate this transaction. EVI may store this information to verify the transaction for customer service and accounting reasons. EVI may also share this information with other third parties on an aggregate basis, but it does not indicate the identity of individual users. Notwithstanding the above, You retain exclusive ownership rights over Your proprietary business data, information and strategy, as well as the data or other information entered on the EVI Website as part of conducting Your business using our Solution and website. EVI reserves the right to collect information from activity on its Website. In addition, EVI reserves the right to anonymize, aggregate, and analyze such information, and to create “meta data” (meta data is data that describes data). In no event will You, Your users specific data, information and strategy, and/or any other information relating specifically to You or Your users be identifiable. Any such meta data is the exclusive property of EVI.
Security on the EVI Website
The EVI Website has security measures in place to protect the loss, misuse, and alteration of the information under EVI’s control. EVI employs strict security measures to safeguard online transactions. All personal information is stored in a secured database.
Children’s Privacy Protection
The EVI Website covered by this Terms of Use policy is not designed for, or targeted at, children. EVI will not knowingly collect and maintain personally identifiable information from children 13 years of age or Younger.
Opt-In
The EVI Website gives users the opportunity to opt-in to receive communications and information from EVI at the point where EVI requests information about the user. Our website also gives users the options listed below for removing their information from EVI’s database in order to stop receiving communications, information, or services; and for reviewing, changing and modifying information previously provided. In addition, the EVI Solution allows users the opportunity to opt-in to access and utilize the software. The EVI Solution also gives authorized users the opportunities listed below for removing their information from the software and associated software databases, or for changing and modifying their information. EVI reserves the right to change the terms, conditions, and notices under which the EVI Solution and the EVI Public Website are offered. You are responsible for regularly reviewing these terms and conditions. However, please note that we will give users the opportunity to opt-out or prohibit new or unrelated uses of their personal information.
